BuildGenius is an AI-powered construction cost estimation platform developed and operated by Deyva Infotech that provides:

• AI floor plan analysis and measurement extraction
• Bill of Quantities (BOQ) generation with 14+ modules
• Construction cost estimation for residential and commercial projects
• Building code compliance checking
• Professional report generation (PDF, DOCX, Excel)
• Project management and team collaboration tools
• Insurance claims estimation
• Shareable client estimate links

3. User Accounts

3.1 Registration

You must register for an account to use BuildGenius. You agree to provide accurate information and keep it updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Subscription Plans & Billing

4.1 Plans

BuildGenius offers the following subscription tiers:

• Free: $0/month — 1 estimate, all features unlocked
• Starter: $49/month — 15 estimates, priority support
• Professional: $129/month — 60 estimates, team collaboration
• Business: $299/month — Unlimited estimates, white-label, API access

4.2 Billing

Subscriptions are billed monthly or annually in advance. Payments are processed securely via Paddle.

4.3 Usage Limits

Each plan has monthly estimate limits. Exceeding limits may result in service restrictions until you upgrade your plan.

5. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Upload malicious files or content
• Attempt to reverse-engineer or hack the Service
• Share account credentials with unauthorized users
• Resell or redistribute the Service without authorization
• Use automated tools to scrape or abuse the Service
• Interfere with the Service's operation or security

6. Intellectual Property

6.1 Our IP

BuildGenius, including its software, AI models, designs, and content, is owned by Deyva Infotech and protected by intellectual property laws.

6.2 Your Content

You retain ownership of floor plans and project data you upload. You grant us a license to process this data to provide the Service.

6.3 Generated Reports

Estimates and reports generated by BuildGenius are yours to use for business purposes.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

• Estimates are for guidance only and should not replace professional judgment
• Actual construction costs may vary based on market conditions, labor availability, and other factors
• AI analysis accuracy depends on floor plan quality and clarity
• Code compliance checks are advisory and do not replace professional review

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Deyva Infotech and BuildGenius shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for losses arising from reliance on estimates or reports

9. Indemnification

You agree to indemnify and hold Deyva Infotech and BuildGenius harmless from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for significant changes.

11. Governing Law

These Terms are governed by the applicable laws of the jurisdiction in which Deyva Infotech operates, without regard to conflict of law principles.

12. Dispute Resolution

Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in court. Parties will attempt mediation before proceeding to arbitration.

13. Changes to Terms

We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the new terms.
